Terms of Use

These Terms of Use (“Terms”) govern access to and use of the website operated by Kapella at this domain (the “Website”). By accessing the Website you agree to these Terms. If you do not agree, you must not use the Website.

Effective date: 15 August 2026

Operator: Kapella, 29 Ekim Mah. 10002 Sk. No:16, Menemen / İzmir, Republic of Türkiye. Contact: [email protected], tel. +90 232 329 06 06.

1. Nature of the Website

The Website presents information about Kapella’s waste-chute, linen-chute, chimney and related engineered systems, together with news, references and contact facilities. Content is provided for general information to professional buyers, consultants and partners. It does not constitute an offer capable of acceptance, a quotation, a specification for a particular project, or engineering advice on which you may rely without independent verification.

2. No online sale of goods

The Website is not an e-commerce storefront. Prices, lead times, certifications applicable to a given configuration, and scope of supply are confirmed only in a written quotation, purchase order acknowledgement or contract issued by Kapella. Nothing on the Website obliges Kapella to enter into a supply contract with any person.

3. Enquiries and user-submitted information

If you submit an enquiry, quote request or other form, you warrant that the information is accurate, that you are authorised to send it, and that it does not infringe third-party rights or contain unlawful material. You grant Kapella a non-exclusive licence to use that information solely to assess and respond to the enquiry and, where relevant, to prepare a commercial proposal. Do not send information that is classified, export-controlled or subject to a confidentiality duty unless a separate non-disclosure agreement is in force.

4. Intellectual property

All trademarks, logos, product names, drawings, photographs, texts, software and layout of the Website are owned by Kapella or its licensors. You may view and print pages for internal evaluation of Kapella products. You may not copy, scrape, frame, reverse engineer, or use Website materials for competing product literature, training or public distribution without our prior written consent. Product images and typical arrangements are illustrative and may differ from the goods ultimately supplied.

5. Acceptable use

You shall not misuse the Website, including by introducing malware; attempting unauthorised access to servers, accounts or data; overloading the service; harvesting contact details; or using automated means to extract content except for bona fide indexing by publicly available search engines. We may suspend access, without notice, where we reasonably suspect a breach of these Terms or a security risk.

6. Third-party sites and documents

Links to third-party websites, maps, social networks or downloadable files are provided for convenience. Kapella does not control and is not responsible for their content, availability or privacy practices. Download of CAD, PDF or similar files is at your own risk; you remain responsible for checking that files are suitable for your CAD environment and project.

7. Disclaimer of warranties

The Website is provided “as is” and “as available”. To the fullest extent permitted by law, Kapella disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Technical data, dimensions, fire ratings and standards references on the Website are indicative. Binding performance, certification coverage and installation conditions are those stated in the applicable Kapella quotation, data sheet or contract for the specific order.

8. Limitation of liability

To the fullest extent permitted by applicable law, Kapella shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data, business or goodwill, arising out of or in connection with use of the Website, whether in contract, tort (including negligence) or otherwise. Kapella’s aggregate liability arising from Website use shall not exceed one hundred euros (EUR 100) or the equivalent in Turkish lira. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under the mandatory laws of Türkiye.

This clause applies to Website use only. Liability for supplied products and installation services is governed exclusively by the commercial contract for that supply.

9. Languages and translations

The Website is available in English, Russian and Arabic. In the event of inconsistency between language versions of these Terms, the English version shall prevail, except where a mandatory rule of law requires otherwise.

10. Privacy and cookies

Processing of personal data in connection with the Website (including enquiries and server logs) is described in our Cookie Policy and, where applicable, in notices displayed on individual forms. By using the Website you acknowledge those notices.

11. Changes

Kapella may modify the Website or these Terms at any time. The updated Terms will be posted on this page with a revised effective date. Continued use after posting constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms, and any non-contractual obligations arising out of them, are governed by the laws of the Republic of Türkiye. The courts of İzmir, Türkiye, shall have exclusive jurisdiction, without prejudice to any mandatory consumer or other protective venue that cannot be waived.

13. Contact

Legal notices concerning the Website may be sent to [email protected] or to the postal address set out above.
